So I was out taking Pinot for a walk and thought how exciting.... the park is almost complete. I love the covered shade areas over the play area but I have to say I am also impressed with excersise equipment on the walking path throughout the park. Love it but I might have to change my mind set that parks are for play and relaxation..

Special Assessment coming to Portola Hills HOAII Homeowners.

Thought those of you who live in Portola Hills II HOA section might be interested in some highlights from the HOA meeting on 8/10.

I decided to attend for two reasons: one a presentation from the city of Lake Forest was to address the communities traffic concerns with the upcoming Portola Center Development and two there was to be a discussion about the upcoming Special Assessment coming to homeowners for the hill sliding off of Highridge.

I have to say, 1st I was really shocked with the 2 topics at hand how light the attendance was. A total of 11 attendees was there and not all homeowners.

The Lake Forest City spokesperson spoke about recent changes to Saddleback Ranch..... Did you see that little pork chop figure when you come up Saddleback Ranch and make a right onto Malabar, that is it but other than that there was no discussion about the concerns regarding Portola Center. In addition, he spoke about the the Alton completion with a tentative schedule of April 2012.   He also spoke about Rancho Parkway, being opened up and completed in Dec 2012 with the addition of the new Sports Park.

Regarding new development, it was mentioned that the new development off of Bake from Shea Homes were aggressively proceeding and would be complete 2012/2013. It was also mentioned how much traffic that would put at Bake and Portola and how the current traffic study has the intersection rated as an F. Yes that is correct, F for Failure! When asked about the improvement the city expected he estimated up to E. I have no knowledge of traffic engineering but from what I understand the standard should be a C.

Regarding the upcoming special assessment, it was a little pre-mature to attend this meeting because there were no answers. The board is trying to figure out what would work best. But if you look at the simple math and the last notice homeowners received....... up to 250k, needs to be absorbed by 690 homeowners.   I would not want to be in the boards shoes having to determine what is the best way to get those funds.

In regards to Portola Center, it is still in the works but the city mentioned it is not being pushed from the developers as hard as the Shea project. Of course, the current economy is a critical factor.

Now with the above, I did think OK, do the Portola Hills Homeowners really care about these details with such low attendance? You tell me is it important......

Just Sold 28366 Klondike Dr.... Kelly Did It Again - Record 2011 Price!

So excited for our seller as she has moved into her new home and we successfully sold her Montecido Townhome in Portola Hills. As you can see from the photo's this was a lovely home in a great location; two key assets, along with our extensive understanding of the current market, ensuring our homeowner received top dollar in this tough market!

I admit, it drives me crazy to see homeowners sell their home at the bottom of the market, when there is opportunity to bring them a higher sales price. That's why our track record speaks for itself. This home sold for 10% over most recent sales in the complex. The best part of today's market is, if you price your home out of range, then it is not going to appraise. Lenders are being very stringent on the numbers and the money they are loaning on. It will also stay on the market a longer time, which will eventually hurt your overall pricing strategy. However, that does not mean you should price your home below market. Real Estate is local, that includes what is happening in your specfic neighborhood but also in the surrounding area.

Pricing is 100% in control of the homeowner! Guidance only comes from your real estate professional, always remember the numbers don't lie. This is why it is critical to your success to review what is most important for you as the homeowner, price, timing, etc. Then review it with at least three Realtors. Ask yourself why does one home sell for less then another home if they are apple to apples. A couple dollars off is not an issue, 10% and over the last Sold, hmmm. What does this Realtor do different? Does your Real Estate Professionals track record match what is happening in the market, in regards to timing and price? Some Good News for Short Sellers with Junior Leins.

Finally a little good news for those who need to short sale and have two loans.

Just a quick note so you have the information regarding SB 458, which mandates Junior Lien Holders to accept short sale terms as final payment. As C.A.R President Beth Peerce notes, "SB 458 brings closure and certainty to the short sale process and ensures that once a lender has agreed to a accept a short sale payment on a property, All Leinholders - those in first position and in junior positions - will consider the outstanding balance as paid in full and the homeowner will not held responsible for any additional payments on the property"

I believe the decision to short sale never comes easy and though I also believe the homeowner has to work hard to ensure they can keep their home, much of what is happening today is out of their control. I am a strong advocate for Homeowners rights and believe they have been getting a raw deal when it comes to the devastating housing market. More and more we here lenders knew, insured against and made millions off of the fraud they created. We are also hearing they are beginning to pay back millions due to their admission that there was huge fraud in products they created which was a major factor in the collapse of financial markets.

I don't understand why with all the admissions out there of fraud, Lenders are not proactively helping homeowners or why they are not being held more accountable, but this is a good first step. There is key detail here we need to watch out for and that is when second leinholders agrees. Getting the agreement from a second lienholders is often the hardest hurdle to overcome in a short sale.

It is highly recommend if you are going through a short sale to review the details with a variety of professionals, i.e. Licensed Real Estate Professional, Accountant and Lawyer to ensure you have a complete understanding of process, pros and cons.

Three Short Sale Facts Portola Hills Residents Should Consider

We often here these days in the local news that Portola Hills is the hottest Real Estate market in Orange County, unfortunately that does come with some sad news as the percentage of homes in distressed situations is also one of the highest in the county.

Below are four quick facts and solutions you should think about if you are considering getting out from your current home.

Fact: Loan Modifications are hard to come by and if they do, it is rare to receive true Principle Reductions, which is what is needed. Principle Forbearance is more likely than a Principle Reduction.

Fact: A Quarter of all mortgage holders in Southern California owe more on their mortgage than their property is worth.

Fact: Foreclosure is more damaging to your credit and future employment.

Solution - A Short sale will accomplish three things for you.

1st: Allow you to take some control back in your life. Stop with the frustrating calls to your lender with no answers.
2nd: Give you a fresh start credit wise and even allow you to possibly purchase a home sooner then you think. Short Sales are considered a settlement not a walk away.
3rd: Allow you and your family to move forward with Dignity.

Now there are a lot of things floating around that say No Cost or Zero Cost Short Sale. this is true in the aspect that once a Short Sale is approved the Lender will take over all cost.

The real cost to you comes from selecting the wrong agent to help you with your short sale. There are many agents who shy away from taking short sale listings as they do not want to sit on the phone day in and day out for maybes. The agents that are successful in the Short Sale arena are agents who have established a relationship with the lenders but most importantly have a strong team to back them up.  Make sure to ask your Agent - are they working direct or do they have a strong negotiation team that understands what is happening with the Lenders, 2nd Liens and the Government Programs. Just as you want the most money for your home you listed so would a lender. The Agents focus should be on selling your home at the most $$ possibly and quickly. This can only be successful with a Strong Team and a real understanding of lenders are expecting.

However, I see far too many homes listed very low compared to comparables just so they can get multiple offers and start the short sale process.  This does you the homeowner no good because once the lender reviews and see's the home is priced too low they will reject the buyer and you will start the process all over.   What has this cost you......Time!

Portola Hills Residents Holding City Officials Accountable

At the recent Portola Center Meeting in Portola Hills, many questions came up regarding the agreement between the developer and Saddleback Valley Unified School and ensuring those funds were used for the improvements at Portola Hills Elementary. Below is a note direct from Lake Forest's Planning Manager, Cheryl Kuta.

Thank you for attending the Portola Hills community meeting on August 18, 2010 and listening to the City’s presentation on the history of the Opportunities Study, including the Portola Center project, as well as a discussion of the City’s role in the review of the proposed plans for Portola Center. We are currently working on responses to the written questions received during the presentation, as well as a general list of Frequently Asked Questions that will be made available on the City’s website. Our goal is to maintain an open and productive dialog with the community throughout the review of the Portola Center project.

One of the issues discussed at length at the community meeting was the School Mitigation Agreement that Portola Center entered into with Saddleback Valley Unified School District. We have reviewed the terms of the School Mitigation Agreement and have confirmed that the document does specify how and where the fees paid by Portola Center are to be used, as summarized below.
• School Mitigation Fees: Payment of the $8,410 per residential unit fee is paid at the issuance of a building permit for each unit; the District is required to spend the fees on school facilities within the City of Lake Forest.

• Portola Hills Elementary Repairs: A payment of $2,900,000 is due to the District at the time the first residential building permit is issued within the Portola Center project. The agreement specifies that the money shall be used for modernization of Portola Hills Elementary School. The agreement also specifies that the District must make the repairs as soon as reasonably feasible.
Once again, I would like to take the opportunity to thank you for your interest in the City of Lake Forest and welcome you to continue to dialog with the City on issues that are important to your community.

As a result of Portola Hills Elementary School not being available during the summer, we are very appreciative of the cooperation of the Portola Hills I HOA for allowing us to use their recreation room. We have made a request of each HOA to provide a Board representative to create a steering committee to provide input into agenda development over the next year. Portola Hills - Highest Percentage of Distressed Properties in Orange County

OK, this is disturbing... According to a report in the Orange County Register this morning, Portola Hills has the highest percentage of homes currently on the market that are in distressed situation.

First, Distressed is identified as any property that is either being sold as a Short Sale/REO/or has a Notice of Default.

Currently in Portola there are 16 active properties listed on the market and 10 of the properties are listed as Distressed.

So if you do the math, 10 of 16 equals 62%, which is high! But there is a key point missing in this report and that is there are only 16 homes for sale in Portola Hills.

Overall in Orange County the number of distressed homes on the market equals 30%.

So what does this mean. There is no doubt Portola Hills like everywhere else is being effected by the current market.   The difference however is the low inventory. With only 16 homes on the market the demand for the area does tend to out weigh negative perception, especially if the home is an Equity or Standard Sale.

Looking at the average days on the market shows where the true demand is.

Overall:                       Average Days on the market 79
Distressed Properties: Average Days on the market 115 days
Standard Sales:       Average Days on the market 32

Still wondering where the good news is here? If you are a Portola Hills (equity) homeowner who is considering selling your home, NOW is actually a very good time to list your home as long as you are realistic with pricing! The demand is there, but the market is not going to bear over priced homes.

Last night to a "small" crowd of Portola Hills residents and the developers (Rancho Portola Investments, LLC and USA Portola Properties, LLC) gave an update of the current status of the new development coming to Portola Hills.

Overall it was just a briefing that often got side tracked as it is evident residents aren't over ally happy about the new development. But whether happy or not, it is coming as the land owners have a right to develop the land they own and the city of Lake Forest is builtout. Hopefully there is truth in what the developers noted and they plan to work with the community to ensure the communities needs and concerns are met.

First off, with the current economy there has no doubt been a delay but work is beginning. The prelim project has been approved by the city now the developer is working on the final approvals that will take at least 12 months, with community reviews along the way through the environmental process. That being said, ideally the construction will most likely start in about 18 months, of course sooner if the real estate market permits.

One aspect of the project is being pushed forward which was originally going to be the last portion of the project and that is the release of the open space. The developers have agreed to reserve or give up (not sure what the right term is) 30 acres of open space to the city and/or county. This will happen on the front end.

In addition, in early April the city finalized the purchase of a 6 acre parcel from a private party which is located 1300 ft north of Glen Ranch Road and is adjacent to Whiting Ranch Wilderness Park. "The goal of this purchase is to preserve open space and respond to the cities desire to expand recreation facilities i.e. sports parks" you can find more details about this at http://www.ocparks.com/whitingranch.

A couple of key things have changed. Originally the plan noted for 40,000 sq. ft of commercial, the new plan is to reduce that amount and increase the number of single family homes vs. multi-family homes. Estimated numbers now are 10,000 -12,000 sq. ft commercial and 930 residential units.

Concerns from the community include:

Requirement of affordable housing and what this includes

Traffic concerns with an increase of 3000 residents to the area

Timing of when traffic studies will be concluded (last traffic study was during the summer when traffic is at it's lowest point)

Parking concerns with the current multi-family developments and adding more

Portola Elementary Repairs

Quality concerns with the developer Baldwin & Sons, due to previous construction issues and lawsuits.

Retail development and what it includes

Lack of city services representation and school district in the process

Overall for most Portola Hills residents keeping the current natural appeal is very important. So feedback to the developers and the city of Lake Forest is critical.

On a personal note, from my professional experience, the increase in Single Family Homes vs. Multi-Family homes is going to come down to a final market review. Where the real estate demands is going to be key in what mix is finalized. There is only so much space so increasing the number of Single Family Homes means either the lot sizes are going to be smaller or the homes sizes are going to be smaller.

As a home owner and real estate professional in the area, a key attribute to the appeal of the area is generally Portola Hills has larger lot sizes with great views. I hope the developers keep this in mind.

This makes me mad. When speaking to clients regarding Short Sales the majority do not understand the tax consequences of a Short Sale. Alot of that confusion comes from the fact that the Federal Gov't is not currently requiring a tax, but depending on the state you live in the homeowner may still be liable for the loss as is the current rule for California homes.

As many of my Portola Hills clients know, I am not one to jump on the short sale band wagon. That doesn't mean I won't do one, I just won't do one for the sole reason to get a sale. It is imperative for my clients to truly understand what the outcome of a short sale can be. Recently I had a client call me, I did not do their short sale and asked "Kelly we just got a 1099 for the difference between what we ended up selling for and what owed, what are we suppose to do with this"

This is a common question, first please, please, please if you are going to do a short sale make sure to read your contract to ensure the lender can not come after you for the difference at a later point. Secondly please speak with a tax professional to understand in your state what the tax consequences are. Also I recommend speaking with a financial counselor to discuss how it will impact your credit. No doubt, your credit is going to be shot, but that is not forever.

I came across this video, that clearly explains why banks push for short sales. In my opinion if the bank is pushing for something, go the opposite direction. I don't want to sound harsh we just all know where their loyality lies these days and it is not with their customers rather their bottom line. So check it out.

Hey Gang, It's Kelly!

Ok, we all know Thanksgiving is about enjoying the day with the Thankful heart. We also know it is about our favorite foods that as a family you enjoy and want to pass on through the years. So let's share, what is your favorite Thanksgiving food?

For me, it has to be Scallop Corn. I love it and if I happen to not be cooking that year and the host doesn't mention it then I am off to the store to ensure each year we have it on the table! Plus it is the easiest thing to make, below is the basic recipe!

2 cans creamed corn
1 can of sweet corn kernels
2 bundles of ritz crackers
2 eggs
1/2 cup of cream
1 stick of butter

beat egg, cream together
cube butter
crush ritz crackers

mix together all ingredients and place in a baking dish - cook on 350 for 45 minutes. Traditionally this is cooked in a shallow backing dish. I cook it in deep dish and whip vs. mix the ingredients so it comes out a bit lighter.

I was looking for properties for a new buyers in Portola Hills recently and was a bit amazed that more weren't showing up. As I expanded my search I came across several homes that were listed in the wrong city.

Wrong city you say, how could this be? In the example of Portola Hills this may happen because the area use to be part of the unicoroprated area of Trabuco Canyon. However, Portola Hills was annexed into the city of Lake Forest in 2000.

This is a perfect example of why home sellers want to hire an agent who is active in their community and understand both the area, title requirements and mls requirements.

First if you live in the Portola Hills, you understand all the benefits of the area and this is what you need sell!
Second there are specific requirements about how your title will be held and the correct city is a major requirement. If you don't want delays in your escrow closing, your agent and the buying agent needs to make sure this is correct.
Third, MLS requirements - The sucess of buyers finding your home is all based on the correct search criteria being utalized. If your home is listed in the wrong city and your buyers are looking for a home in a specefic area then your home is not going to be seen.

Hard to believe 2005 was 4 years ago. Wow how long has this recession really gone on? For many it began in late 2005 and those who have stuck it out are beginning to see an opportunity to make a move in the right direction.

Why do I say right direction, well if you were a home seller who in 2005 was thinking about moving up and buying a new home but held off, then you are in a perfect position to take advantage of where the market is today.

As you will note from this attached article the inventory levels today have not been this low since 2005. If you understand the rule of supply and demand and are realistic about where home pricing is then you have the opportunity to find that move up home at buyers pricing vs. at sellers pricing. If you think back 2005 it was all about the sellers!

There is a demand for equity sellers on the current market, why buyers are tired of sitting on the fence and realize that benefits such as the $8000.00 tax credit low interest rates will not continue forever. There currently are no condo's active on the Portola Hills market.

Closed Properties /Average Price: 32

Condo's: 20 homes have closed escrow since Januarary 2009. 3 bedroom / 1 car garage /Average Sq. footage 1119 = $259. price per sq. foot or an average price of $290,134.

Single Family Residences: 12 homes have closed escrow since Jan. 2009 = 4 bedroom / 3 car garage/ 2440 sq. ft = $245.19 price per sq. foot or an average price of $587,775

So the question begs to be asked is it a good time to list your home? If you are an equity seller that is realistic about the current market and can accept where the pricing is. It is a great time to list!

I was reading an article today that caught my attention on the O.C. Register. The reason it caught my attention is because it was in a sense trying to be positive yet it's very nature was negative. I have posted before, that the media only focus is bad news so it doesn't surprise me, but as the article mentioned Portola Hills, I thought I would put a positive spin on it.

The article "What's the jobless rate in your O.C. city" notes that the most recent Orange County unemployment rate is 7.9% and then breaks it down by city. For Portola Hills that rate is 3.9%. Though I don't want to take away the fact that unemployment is hurting everyone, if we just switched the wording around don't you think the stress from those words would be much different.....

In these difficult times, focus on the Possibilities.

Portola Hills Mello Roos - Wonder what the maturity dates of the mello roos bonds in the area are:

S2 Mello Roos – Current bond is schedule to mature 2016
R3 Mello Roos – Current bond is schedule to mature 2015
Q1 Mello Roos – Current bond is schedule to mature 2011

One thing to keep in mind w/Mello Roos bonds they have individual terms and though the maturity dates could continue further. Example – The S2 Mello-Roos has no specified end date, however the bonds that have been issued thus far are scheduled to mature in 2016. The district has not yet issued up to the maximum authorized amount of bonds which means they could issue more bonds if they see a need and Mello-Roos could continue until all authorized bonds have been issued and are paid off.

When attending the Community update of the Portola Hills Center it was mentioned that the new development may help in reducing these bonds for current residents as they would spread over the new development.

Portola Center Update: Wandering what is the next phase of the development is? I had a quick conversation with the developer to see what the status was and he noted the following:

“We are in the process of preparing the next round of plans for Portola
Center, which include an Area Plan and subdivisions maps. We hope to submit these plans to the City in about a month. Based on these plans the City will have to prepare an Subsequent EIR evaluating the environmental impact of the proposed plans. That process should take about 9 months”
